1. Purpose
These terms of use (the “Terms”) set out the rules for accessing and using the 94 Seconds game (the “App”) and the website that presents it (the “Site”), published by SAS ELIA, a simplified joint-stock company with a share capital of €55,550, 243 rue de l'œillade, Saint Gély du Fesc, France — 881 343 727 R.C.S. Montpellier (the “Publisher”).
Purchases made inside the App are governed by the terms of sale, which supplement these Terms.
2. Acceptance
Downloading, installing or using the App means you accept these Terms in full. If you do not accept them, you must stop using the App and uninstall it.
3. What the service is
94 Seconds is a timed word game: in each round, a topic and a letter are shown, and the player must type a matching word before time runs out. The App includes a free-play mode, a daily challenge with a leaderboard, a topic collection, jokers, level progression and statistics.
The App is free. It contains advertising and offers optional in-app purchases (coin packs, a Premium subscription). The Publisher may change, add or remove features and content at any time, in particular for technical, editorial or game-balance reasons.
4. Access and requirements
Using the App requires a compatible up-to-date iOS or Android device and, for some features (daily challenge, leaderboard, sync, advertising, purchases), an internet connection whose cost is yours to bear. Part of the content remains playable offline.
The Publisher does not guarantee uninterrupted access: the service may be suspended for maintenance, updates, or if a technical provider fails.
5. Player account
The App can be used with an anonymous account. Creating an identified account keeps your progress, lets you join the leaderboard and restores your data after reinstalling or switching devices.
- The information you provide must be accurate and kept up to date.
- You are responsible for keeping your credentials confidential and for anything done from your account.
- A nickname that is abusive, misleading, infringes a third party's rights or offends public order may be changed or removed.
- You may delete your account at any time; doing so permanently erases your progress and any unspent coins.
6. Rules of use
When using the App, you agree not to:
- cheat, automate gameplay, or use a bot, script, modified emulator or any device meant to gain an advantage over other players;
- tamper with scores, leaderboards, XP or the in-game currency;
- decompile, disassemble or modify the App, except as permitted by law;
- extract, copy or reuse the topic and word databases, in whole or in part;
- disrupt the service or attempt to access servers and data without authorisation;
- use multiple accounts to evade a sanction or distort a leaderboard.
In the event of a breach, the Publisher may reset a score, withdraw a reward, or suspend or delete the account concerned, without compensation.
7. Virtual currency and rewards
Coins, XP, levels and in-game rewards are virtual items internal to the App. They have no monetary value, cannot be exchanged, transferred or redeemed for money, and cannot be used outside the App. Balances may be adjusted in the event of a technical error or fraud.
8. Intellectual property
The App, the Site and all of their elements (code, interfaces, graphics, logos, sounds, texts, word and topic databases) are protected and remain the exclusive property of the Publisher or its partners. The Publisher grants you a personal, non-exclusive, non-transferable and revocable right of use, strictly limited to private use of the App and excluding any commercial use.
Sharing videos or screenshots of your games (streaming, social media) is allowed for non-commercial purposes, provided you name the game and do not imply a partnership with the Publisher.
9. Reporting content
The word and topic databases exist for entertainment and may contain errors, omissions or regional variants. Suggestions, corrections and reports are welcome at contact@elia.games.
10. Personal data
How your data is processed, for which purposes, by which providers, and how to exercise your rights are described in the legal notice and privacy policy.
11. Advertising
The App is partly funded by advertising. Some ads are optional and rewarded: watching one voluntarily grants an in-game benefit. Advertisers and ad networks are responsible for the content of their ads. The Premium subscription removes advertising, under the conditions set out in the terms of sale.
12. Liability
The Publisher is liable for the proper functioning of the App as provided by law. It is not liable for damage resulting from use that breaches these Terms, from a failure of your device or connection, from force majeure, or for progress lost by uninstalling the App without an identified account.
Nothing in these Terms excludes the statutory warranties of conformity and against hidden defects that consumers benefit from.
13. Term, suspension and termination
These Terms apply for as long as you use the App. You may end them at any time by uninstalling the App and, where applicable, deleting your account. The Publisher may suspend or terminate access in the event of a serious or repeated breach, with prior notice where circumstances allow, or discontinue the service after informing players by appropriate means.
14. Changes to these Terms
These Terms may be amended to reflect legal, technical or functional changes. The applicable version is the one published on this page; the date of the last update appears at the top. Continuing to use the App after publication means you accept the new version.
15. Governing law and disputes
These Terms are governed by French law. In the event of a disagreement, please first contact the Publisher at contact@elia.games to look for an amicable solution. Failing agreement, the French courts have jurisdiction, subject to the rules of jurisdiction that apply to consumers.
